Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Masam mobile application (the "Service") operated by Masam ("us", "we", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
Use of the Service
Masam provides a platform for discovering restaurants and dining experiences in Baku, Azerbaijan. The Service allows you to:
- Browse and discover restaurants
- View restaurant information, photos, and details
- Save favorite restaurants to personal lists
- Use the concierge chat to receive restaurant suggestions
- Access restaurant contact information
Accounts
When you create an account, you must provide accurate and complete information. You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service
- Upload malicious code or content
- Scrape, copy, or redistribute content without permission
- Impersonate others or misrepresent your affiliation
User Content
You retain ownership of content you submit to the Service. By posting content, you grant us a non-exclusive, worldwide license to use, display, and distribute that content in connection with the Service.
You are responsible for ensuring your content does not violate any laws or third-party rights.
Intellectual Property
The Service and its original content, features, and functionality are owned by Masam and are protected by international copyright, trademark, and other intellectual property laws.
Third-Party Content
The Service may display content from restaurants and other third parties. We do not guarantee the accuracy of this information and are not responsible for third-party content or services.
Disclaimer
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that:
- The Service will be uninterrupted or error-free
- Restaurant information will be accurate or current
- Defects will be corrected
Limitation of Liability
To the maximum extent permitted by law, Masam shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
Account Deletion
You may delete your account at any time through the app settings. Upon deletion, your personal data will be removed or anonymized in accordance with our Privacy Policy.
Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms in the app. Continued use of the Service after changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by the laws of Azerbaijan. Any disputes shall be resolved in the courts of Baku, Azerbaijan.
Apple App Store Provisions
If you download the Service from the Apple App Store, the following additional terms apply:
- Acknowledgement: These Terms are concluded between you and Masam only, and not with Apple, Inc. ("Apple"). Masam, not Apple, is solely responsible for the Service and the content thereof.
- Scope of License: The license granted to you for the Service is limited to a non-transferable license to use the Service on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Maintenance and Support: Masam is solely responsible for providing any maintenance and support services with respect to the Service. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.
- Warranty: Masam is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.
- Product Claims: Masam, not Apple, is responsible for addressing any claims of yours or any third party relating to the Service or your possession and/or use of the Service, including, but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual Property Rights: In the event of any third party claim that the Service or your possession and use of the Service infringes that third party’s intellectual property rights, Masam, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
- Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using the Service (e.g., you must not be in violation of your wireless data service agreement when using the Service).
- Third Party Beneficiary: Apple, and Apple’s subsidiaries, are third party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
